UK Parliament vote on Theresa May’s Brexit plan a make or break moment for the prime minister, exit movement

In a devastating blow to British Prime Minister Theresa May, the British Parliament rejected a bill Tuesday that lists the terms of the United Kingdom’s withdrawal from the European Union — more than two years after the country’s historic 2016 referendum that resulted in the decision to depart the E.U.

The House of Commons voted 432 -202 against the deal, said to be the largest defeat in House of Commons history and catastrophic for May.

May had urged Parliament to vote in favor of her Brexit deal, which she struck with the E.U. in November.  But ahead of the vote, signs were not pointing in favor of May, who has faced criticism from members of her own party for her handling of Britain’s departure from the E.U. and in December survived a vote of confidence in the leadership of her party.

A thumbs-down vote on the divorce deal throws British politics further into turmoil, just 10 weeks before Britain is due to leave the E.U. on March 29. It’s also possible the country could leave the bloc without a deal, which economists have warned could have devastating effects on the British economy.

The deal faced deep opposition from both sides of Britain’s divide over Europe. Pro-Brexit lawmakers say the deal will leave Britain bound indefinitely to E.U. rules, while pro-E.U. politicians favor an even closer economic relationship with the bloc.

Here’s what you need to know about Brexit and the departure agreement.

First, what is Brexit?

Brexit — or “British Exit” — refers to the U.K.’s choice to leave the E.U., which is an “economic and political partnership” that currently consists of 28 countries in Europe, according to the BBC.

What has happened since the U.K. voted to leave the E.U.?

May and other U.K. leaders have worked with the E.U. to negotiate and agree on the terms of the country’s exit from the E.U., which will occur on March 29 whether or not there is a deal, the BBC reported.

Negotiations between the two sides have led to a 585-page withdrawal agreement. The agreement, in part, details the terms of the U.K.’s departure from the E.U.

Namely, this includes how much money the U.K. is required to pay the E.U., (estimated £39 billion or more than $49 billion), what will happen to the E.U citizens living in the U.K. and vice versa, and how to prevent a physical border between Northern Ireland and the Republic of Ireland “when it becomes the frontier between the U.K. and the E.U.,” the BBC reported. This has also been referred to as the “backstop plan.”

The E.U. says that there can be no deal without the backstop to guarantee an open border along the U.K.’s only land frontier with an E.U. member state. But pro-Brexit supporters say this part of the agreement will bind the U.K. to many E.U. laws, CNBC reported.

What happens now that Parliament voted “no” on Jan. 15?

Now that Parliament has voted “no” on the deal, May has until Monday of next week to come back to Parliament with Plan B.

If the deal is rejected by a narrow margin, the government could try again, re-submitting the agreement to Parliament after tweaking it or winning some soothing words from the E.U. to assuage lawmakers’ concerns.

But while E.U. leaders have offered “clarifications” to the deal, they insist the 585-page withdrawal agreement cannot be reopened.

Other options include possibly delaying Britain’s exit or holding a second referendum, which has been driven largely by supporters of the losing “remain” side last time around. But May and her government have firmly opposed this option.

Additionally, there is the possibility that the main opposition Labour Party could call a no-confidence vote in the government if the deal is defeated. The vote would be an attempt to trigger a general election.

The party has not disclosed the timing of such a motion, which could come as early as Tuesday night. Labour leader Jeremy Corbyn told colleagues on Monday that a no-confidence vote was “coming soon.”

What’s the so-called “transition period” and why is it important?

The transition period is a period of time between March 29 and Dec. 21, 2020 that will allow businesses to adjust to the new rules between the U.K. and E.U after Brexit formally begins.

But the transition period will only occur if a deal is met between the E.U. and U.K.

Shutdown writing is tedious because it tends to follow a pattern: Nothing has happened for weeks and nothing is likely to happen for the next couple weeks. Updates to follow.

The wall isn’t even really the point anymore, as if $5 billion could ever do more than pay for a few hundred steel slats along the southern border anyway. Aside from the overflowing toilets at national parks and the army of inconvenienced furloughed federal employees then, the only question that actually matters is who the public will hold responsible when the government reopens.

Of course, President Trump blames Democrats for the shutdown he at first took credit for. (“I would be proud to shut down the government.”) For the last three weeks though, he has been inviting House Speaker Nancy Pelosi, D-Calif., to make a deal.

This strategy isn’t working, and this shutdown won’t stop anytime soon. Recent polling shows why.

The Washington Post and ABC News found that 53 percent of respondents blamed Trump and Republicans in Congress for the shutdown, 29 percent blamed Democrats, and 13 percent blamed both sides.

After first glancing at these numbers, one would assume the White House would realize they were losing the messaging war. But a closer look shows why the shutdown will continue: Trump is getting good scores on this shutdown with Republicans.

Trump promised his base a wall, and the GOP is increasingly getting on board even when construction seems impossible. As the Washington Post reports, support for the wall jumped 16 percent in the last year from 71 to 87 percent.

And this is why the shutdown won’t end anytime soon. Trump continues to get what he wants, namely giving the impression to his supporters that he still fights. He does this by not doing anything. Until something changes drastically, nothing will change at all.

Senate Judiciary Committee members are grilling William Barr, President Trump’s nominee for attorney general, in his first day of confirmation hearings on Capitol Hill.

At the outset, Republican Sen. Lindsey Graham, the new chairman of the committee, told Barr he should expect to face questions about a memo he wrote that contained language critical of the special counsel’s investigation into whether President Trump obstructed justice.

“You will be challenged, You should be challenged. The memo, there will be a lot of talk about it, as there should be,” Graham said.

Barr has been questioned by multiple senators about his views of the investigation into Russian interference in the 2016 election by Special Counsel Robert Mueller.

Barr has repeatedly been pressed to make the case for how he will be independent as the head of the Justice Department, given the president’s repeated berating of former attorney general Jeff Sessions, along with top FBI officials. Here is one such exchange between Democratic Sen. Dick Durbin and Barr.

DURBIN: “A number of my colleagues on both sides have asked, and I’ll bet you’ll hear more, questions along the lines of, what would be your breaking point? When would you pick up and leave? BARR: “Uh, it might give me pause if I was 45 or 50 years old, but it doesn’t give me pause right now. I had a very good life–I have a very good life. I love it. But I also want to help in this circumstance. I’m going to do what I think is right.”

The strike by the union of Los Angeles teachers heads into its second day on Tuesday. In doing so, some 30,000 California-based teachers are exercising a right not enjoyed by teachers in most states.

California is among the minority of states that do permit teachers’ strikes even though most states allow collective bargaining and wage negotiations for public school teachers.

According to the Center for Economic and Policy Research, as of January 2014, 35 states and the District of Columbia outlaw striking. Teacher strikes are legal in 12 states and not covered in statutes or case law in three.

In 1935, Congress passed the National Labor Relations Act (NLRA), which was designed to achieve uniform, effective enforcement of a national labor policy. Congress intentionally exempted states and cities from the NLRA, because government employees traditionally didn’t enjoy a right to strike.

Consequently, the protections of the NLRA apply to private employers, rather than public employers, and leaves states free to regulate labor relationships with their public employees. The result is a wide variation of rules that vary drastically from state to state.

As a default rule, public employees have neither the right to strike nor the right to collectively bargain, unless such rights are provided by a state statute.

In California, labor relations between most local public entities and their employees are governed by a state law called the Meyers-Milias-Brown Act (MMBA), which recognizes the collective bargaining rights of public employees. The MMBA imposes on local public entities a duty to meet and confer in good faith with representatives of employee organizations, in order to reach binding agreements governing wages, hours and working conditions of the agencies’ employees.

If negotiations break down, California allows public employees to go on strike to enforce their collective bargaining demands, unless the striking employees perform jobs that are essential to public welfare, like firefighters and law enforcement personnel. The state’s supreme court has long held that strikes by public employees are lawful, unless the strike creates a “substantial and imminent” threat to public health or safety.

Republican’s questions uncovered revelations that FBI leadership debated if Trump was directed by Russians to fire Comey

Rep. John Ratcliffe confirms his questions to former FBI general counsel James Baker uncovered the claims first reported by the New York Times; Catherine Herridge has the details.

The former top lawyer at the FBI has been under federal investigation for leaking to the media, a letter from House Republicans revealed Tuesday.

The letter from GOP Reps. Jim Jordan and Mark Meadows cited the transcript of a congressional interview with former General Counsel James Baker and his lawyer last fall, where the probe conducted by seasoned U.S. Attorney John Durham was confirmed.

“You may or may not know, [Baker has] been the subject of a leak investigation … a criminal leak investigation that’s still active at the Justice Department,” lawyer Daniel Levin told lawmakers, as he pushed back on questions about his client’s conversations with reporters.

Jordan and Meadows’ letter was sent to Durham, the U.S. attorney for Connecticut, and requested additional information about the probe later this month.

“As we continue our oversight and investigative work, we felt it prudent to write to you seeking an update. Without being apprised of the contours of your leak investigation and Baker’s role, we run the risk of inadvertently interfering with your prosecutorial plans,” they wrote.

The transcript of the closed-door interview and the letter do not include details explaining why the investigation is being led out of the Connecticut office. The status of the investigation is not publicly known.

But the disclosure marks the latest confirmation of a leak investigation involving FBI figures who have since left the bureau.

Last year, former FBI Deputy Director Andrew McCabe saw his leak case referred to the U.S. attorney in Washington, D.C. McCabe was fired for lying to federal investigators about his role in a media leak regarding the Clinton Foundation on the eve of the 2016 presidential election.

“The Committees learned that in some instances, high-ranking DOJ and FBI officials, including the FBI General Counsel James Baker and DOJ Associate Deputy Attorney General Bruce Ohr, took the self-described ‘unusual’ step of inserting themselves into the evidentiary chain of custody.”

Documents reviewed by Fox News indicate that Ohr became the back-channel between Christopher Steele, author of the controversial and unverified anti-Trump “dossier,” and the FBI after he was fired by the bureau for lying about his contact with the media. According to a January 2018 memo by House Intelligence Committee Republicans on government surveillance practices, “Steele was suspended and then terminated as an FBI source for what the FBI defines as the most serious of violations — an authorized disclosure of his relationship with the FBI in an October 30, Mother Jones article.”

According to the DOJ website, Durham is a seasoned prosecutor who has been tapped by Republicans and Democrats to handle high-profile, national controversies.

Durham has held various positions in the District of Connecticut for 35 years, prosecuting organized and violent crime, as well as public corruption. From 2008 to 2012, he also served as the acting U.S. attorney for the Eastern District of Virginia, where he investigated the destruction of CIA interrogation tapes of senior Al Qaeda operatives and, prior to that, he reviewed alleged criminal wrongdoing by FBI personnel in Boston connected to the Whitey Bulger case.

Fox News is reaching out to FBI and Baker, as well as the U.S. Attorney’s office in Connecticut, for comment on the new letter.

    NEW YORK (AP) — A federal judge in New York has barred the Trump administration from adding a question about citizenship to the 2020 census.

    U.S. District Judge Jesse Furman said Tuesday that while such a question would be constitutional, U.S. Commerce Secretary Wilbur Ross had added it arbitrarily and not followed proper procedure.

    The ruling came in a case in which a dozen states or big cities and immigrants’ rights groups argued that adding the question might frighten immigrant households away from participating in the census.

    The decision won’t be the final word on the matter.

    A separate suit on the same issue, filed by the state of California, is underway in San Francisco.

    The U.S. Supreme Court is also poised to address the issue in February.
