A Massachusetts judge and court officer accused of helping an illegal immigrant flee an Immigration and Customs Enforcement agent waiting to take him into custody were indicted Thursday by a federal grand jury for obstruction of justice and three other counts, officials said.

Newton District Court Judge Shelley M. Richmond Joseph and the court officer, identified in court documents as Wesley MacGregor, face several charges stemming from an April 2, 2018 incident in which the pair allegedly helped Jose Medina-Perez get out of the courthouse via a back door in order to elude the ICE agent who sought Medina-Perez.

“This case is about the rule of law. The allegations in today’s indictment involve obstruction by a sitting judge, that is intentional interference with the enforcement of federal law, and that is a crime,” U.S. Attorney for the District of Massachusetts Andrew Lelling said Thursday.

Joseph and MacGregor were both charged with obstruction of justice, aiding and abetting; obstruction of a federal proceeding, aiding and abetting and conspiracy to obstruct justice, Lelling said. MacGregor was also charged with perjury before a federal grand jury.

“As public servants, all of the officers in the court make a promise — a promise to serve the people’s interest above all else. Today we know this promise has been broken,” said Peter Fitzhugh, special agent in charge of the Homeland Security Investigations in Boston, who led the investigation.

Medina-Perez, a twice-deported illegal immigrant with a fugitive warrant for drunken driving in Pennsylvania, had been in Joseph’s courtroom in order to be arraigned on drug charges, the Boston Globe previously reported.

Medina-Perez was the subject of an ICE detainer — a written request to hold an individual wanted for deportation for up to 48 hours — and an ICE agent was waiting in the lobby of the courthouse to detain Medina-Perez after the arraignment, officials said. But during the hearing, Joseph asked Medina-Perez’s attorney “ICE is going to get him?,” according to courtroom recordings obtained by the Boston Globe in December and released in court documents Thursday.

Medina-Perez’s lawyer was also heard telling Joseph “ICE will pick him up if he walks out the front door. But I think the best thing for us to do is clear the fugitive issue and release him on a personal, and hope that he can avoid ICE…That’s the best I can do.”

“What if we detain him?” the judge asked before requesting the clerk to turn off the courtroom’s audio recorder, leaving nearly a minute unrecorded.

Minutes later, Medina-Perez’s attorney said his client “has some property downstairs” and needed to speak to an interpreter, which Joseph allowed.

MacGregor then used his security access card to escort Medina-Perez out of the courthouse without being seen by the ICE agent, officials said.

“With the recorder off, defendant Joseph and the Defense Attorney discussed devising a way to have A.S. [Medina-Perez] avoid being arrested by the ICE officer,” court documents stated.

The ICE agent continued to wait in the lobby not knowing the illegal immigrant already left the building, Lelling said, adding Joseph lied about the incident to her superiors when asked about it.

Joseph was appointed Newton District judge by Massachusetts Gov. Charlie Baker in 2017 after several years serving as a criminal defense attorney and a prosecutor, the Boston Globe reported.

After reports of Joseph’s alleged intervention emerged in December, Baker told reporters he believed Joseph should be benched while the incident was investigated.

“I don’t believe she should be hearing criminal cases until that federal case is resolved,” Baker said about Joseph. “Look, judges are not supposed to be in the business of obstructing justice. And as far as I can tell, based on the facts as they were presented, she clearly violated the court’s own policies with respect to the way they’re supposed to handle continuance and involve federal immigration enforcement.”

Medina-Perez’s freedom was short-lived. He was arrested a month later after the court hearing and again let go, this time by an immigration judge who freed him on bond, the Boston Globe reported. That case is currently pending, officials said. The 38-year-old native of the Dominican Republic had been previously deported in January 2003 and June 2007, ICE said. His real name is Oscar Manuel Peguero, although he goes by several aliases.

Trump’s tweets about Don McGahn and the Mueller report, explained – Vox.com

While special counsel Robert Mueller’s final report about his investigation of Russian interference in the 2016 election stops short of accusing President Donald Trump of crimes, the president is obviously not happy with the picture it paints of him as someone who repeatedly tried to obstruct an investigation of his campaign, only to be thwarted by his own aides refusing to carry out legally dubious orders.

So on Thursday morning, Trump tried to refute on Twitter one of the report’s most damaging revelations — that he tried to get then-White House counsel Don McGahn to order Mueller’s firing via Deputy Attorney General Rod Rosenstein just a month after Mueller was appointed. (McGahn refused.) But in the process, Trump gave House Democrats yet another reason to bring McGahn in for a congressional hearing.

Over the course of two tweets, Trump pushed back on McGahn’s testimony to Mueller that Trump asked him to get the Department of Justice to fire Mueller, and worked in a gratuitous shot at the media in the process.

Trump’s claim that “the Fake News Media” has “incorrectly reported” what the Mueller report says about his dealings with McGahn is false — Mueller’s report actually confirms a report from the New York Times about this. Trump is in fact disputing the conclusions of a government document based on an interview with a lawyer who worked for him.

What the Mueller report says about McGahn

McGahn is one of the Mueller report’s central figures. He’s cited more than any other witness in the document, and his testimony provides some of the starkest examples of how Trump repeatedly tried to impede investigations of his campaign.

McGahn told Mueller that in June 2017 — one month after Mueller’s appointment — the president reacted to reports that Mueller was investigating him for obstruction of justice by calling him at home and “direct[ing] him to call the Acting Attorney General and say that the Special Counsel had conflict of interest and must be removed. McGahn did not carry out the direction, however, deciding that he would resign rather than trigger what he regarded as a potential Saturday Night Massacre.”

In January 2018, the New York Times reported that Trump ordered McGahn to have the Justice Department fire Mueller the previous June. According to what McGahn told Mueller, Trump reacted to the report by asking McGahn to fabricate evidence that could be used to refute it.

“The President then directed [then-White House official Rob] Porter to tell McGahn to create a record to make clear that the President never directed McGahn to fire the Special Counsel,” the report says. “McGahn shrugged off the request, explaining that the media reports were true.”

During a subsequent White House meeting with McGahn, Trump disputed the Times’ reporting on semantic grounds. From the Mueller report:

The President asked McGahn, “Did I say the word ‘fire’?” McGahn responded, “What you said is, ‘Call Rod [Rosenstein], tell Rod that Mueller has conflicts and can’t be the Special Counsel.’ The President responded, “I never said that.” The President said he merely wanted to McGahn to raise the conflicts issue with Rosenstein and leave it to him to decide what to do. McGahn told the President he did not understand the conversation that way and instead had heard, “Call Rod. There are conflicts. Mueller has to go.” The President asked McGahn whether he would “do a correction,” and McGahn said no. McGahn thought the President was testing his mettle to see how committed McGahn was to what happened. [Then-White House chief of staff John] Kelly described the meeting as “a little tense.”

So it’s basically Trump’s word versus McGahn’s. But another part of McGahn’s testimony about his meeting with Trump speaks to why McGahn has more credibility, Trump’s propensity for lying aside:

The President also asked McGahn in the meeting why he had told Special Counsel’s Office investigators that the President had told him to have the Special Counsel removed. McGahn responded that he had to and that his conversations with the President were not protected by attorney-client privilege. The President then asked, “What about these notes? Why do you take notes? Lawyers don’t take notes. I never had a lawyer who took notes.” McGahn responded that he keeps notes because he is a “real lawyer” and explained that notes create a record and are not a bad thing. The President said, “I’ve had a lot of great lawyers, like Roy Cohn. He did not take notes.”

Much as he did during his January 2018 meeting with McGahn, Trump could defend the tweets he posted on Thursday on semantic grounds. After all, McGahn testified that Trump asked him to order the Justice Department to fire Mueller, not that Trump asked him directly “to fire Robert Mueller,” as Trump wrote. In short, read carefully, Trump’s tweets aren’t necessarily inconsistent with the Mueller report, even if the impression they create is at odds with what McGahn told Mueller.

Democrats are trying to get to the bottom of it. The White House is trying to prevent them from doing so.

Trump’s tweets about McGahn give House Democrats yet another reason to bring the former White House counsel in for a hearing in hopes of getting to the bottom of the president’s attempts to obstruct the Mueller investigation. The House Judiciary Committee has already subpoenaed McGahn to testify next month and turn over documents.

There’s just one problem — as my colleague Dylan Scott detailed on Wednesday, the White House has signaled it will fight subpoenas issued by House Democrats that try to compel former aides like McGahn to testify. Trump himself told reporters on Thursday that “we’re fighting all the subpoenas.”

The extent of the Trump administration’s uncooperativeness with subpoenas is unprecedented, and it’s unclear how the battle will play out in court. But what is clear is that Trump is concerned with how McGahn portrayed him, and is trying to push back.

On Monday, the New York Times’s Michael Schmidt reported that Trump believes his political future actually depends on discrediting the account of his conduct McGahn gave to Mueller.

“Trump has privately complained about the accounts, particularly the ones given by Mr. McGahn, and has said the only way to protect himself from impeachment is to attack Mr. Mueller and Mr. McGahn,” according to the Times.

“I have a hard time seeing the coalition ultimately coming together there,” the South Bend, Ind., mayor told The New York Times.

Buttigieg added that at the time “people were refreshed by the novelty of that boldness” of Sanders’s ideas, but that they are now less exciting.

Buttigieg has been criticized this week for saying that in 2016 voters wanted to “blow up the system,” adding that this mentality “could lead you to somebody like Bernie and it could lead you to somebody like Trump. That’s how we got where we are.”

Sanders’s campaign manager, Faiz Shakir, pushed back on Buttigieg’s assertion, touting Sanders’s record of fighting for the working class as the reason he will be able to win in 2020.

“At a time when Trump has lied to millions of Americans and sold out workers, voters are looking for a leader who they can trust will fight for them,” he said in a statement to The Hill.

“He is committed to standing up to powerful corporate interests, taking on the billionaire class, defeating Trump and creating a government that works for all people,” he added.

Sanders, a self-described democratic socialist, and Buttigieg are seen as front-runners among the 20 candidates vying for the 2020 Democratic nomination.

Ending months of speculation, former Vice President Joe Biden announced Thursday he is launching his third presidential campaign. Instantly joining the race as an early frontrunner, the former vice president and more than a dozen major Democratic candidates seek to deny President Trump a second term.

“We are in the battle for the soul of this nation,” he said in the nearly four-minute long video. “If we give Donald Trump eight years in the White House he will forever and fundamentally alter the character of this nation. And I cannot stand by and watch that happen.”

Unlike most of his competitors who only mentioned President Trump in passing when they announced their candidacies, Biden used his video to cast the race as a battle with Mr. Trump for the very soul and character of the country, calling him out by name.

The video opens in Charlottesville, Virginia, the scene of violent clashes between white nationalists and protesters which opens in Charlottesville, Virginia, where in 2017 there were violent clashes between white nationalists and protesters that resulted in the death of one woman. Mr. Trump, at the time, faced a backlash for saying that blame for the violence fell “on many sides.”

Biden announced his bid in a video released on social media. He is expected to hold a fundraiser Thursday evening in Philadelphia and hold his first formal campaign event in Pittsburgh on Monday. In his appeal to voters, Biden recounted the president’s response to the violent white supremacist protests in Charlottesville, Virginia two years ago.

Biden said he’s running for president because everything about American democracy is “at stake” under a Trump presidency. “We have to remember who we are, this is America,” he added in a final appeal to supporters.

Already differentiating himself from the other 17 candidates running, Biden also immediately released Spanish-language advertising to target Latino supporters. None of the other candidates have done this from the start.

For about a year, many Democratic operatives, donors and voters have been encouraging Biden, who served as vice president for eight years under President Obama, to enter the crowded race, capture the nomination and thwart Mr. Trump’s reelection bid in 2020. Despite not having formally announced his bid until Thursday, Biden has been leading several polls among primary voters, with only Vermont Sen. Bernie Sanders coming close to matching the former vice president’s support.

People familiar with the campaign’s plans said Biden plans to place a particular emphasis on South Carolina, an early primary state where he enjoys strong support from longtime Democratic leaders and the state’s large African American community.

The 76-year-old former Delaware lawmaker, a totem of the Democratic Party’s establishment, is likely to quickly attract substantial financial support from the party’s more moderate wing, as well as the backing of many top Democrats across the country and in Washington, where he worked for decades.

Unlike many of the other Democratic candidates in the race, Biden is already a household name across the country, and his allies argue he has the best chance to woo working-class voters in states like Michigan, Wisconsin and Pennsylvania who propelled Mr. Trump to victory during the 2016 presidential election.

The former vice president, however, will also face scrutiny from progressives for some of the positions he held during his long tenure in Congress, where he represented Delaware in the Senate for more than 35 years. In the 1970s, Biden opposed busing to desegregate public schools. As chairman of the Senate Judiciary Committee, he oversaw the contentious Anita Hill hearings during the confirmation process for then-Supreme Court nominee Clarence Thomas in 1991. He also helped spearhead efforts to pass the Violent Crime Control and Law Enforcement Act of 1994, which many believe fueled a period of mass incarceration that disproportionately affected African Americans and other minority groups.

Biden has since embraced more progressive policy stances. He staged two campaigns for the Democratic nomination in 1988 and 2008, dropping out during the primary contests in both.

The former vice president joins the largest — and the most diverse — Democratic primary field in U.S. history. To date, 20 other Democrats have declared their candidacy for president, including Sens. Sanders, Kirsten Gillibrand, Kamala Harris, Cory Booker and Elizabeth Warren; Texas Rep. Beto O’Rourke; and South Bend, Indiana Mayor Pete Buttigieg.

FBI, IRS agents search Baltimore Mayor’s homes, City Hall – AOL

BALTIMORE (AP) — Federal agents executed search warrants Thursday morning at two homes belonging to Baltimore’s embattled mayor and at City Hall.

Dave Fitz, an FBI spokesman out of the agency’s Baltimore office, says agents with the FBI and the IRS criminal division in Washington were “executing court-authorized search warrants” at “both residences and City Hall.” He said he couldn’t immediately release more information because the search warrants are sealed.

Mayor Catherine Pugh’s spokesman, James Bentley, said he has no immediate comment. Pugh’s defense attorney, Steve Silverman, did not immediately return calls.

Pugh has been facing mounting calls for her to resign over a scandal that involves the sale of her children’s books to entities that do business with the city. She was already facing a criminal investigation by the state prosecutor’s office, which began at the request of Republican Gov. Larry Hogan, as well as probes by the Baltimore Inspector General, an ethics board at City Hall and a state insurance commission.

It’s been more than three weeks since Pugh slipped out of sight, citing deteriorating health from a pneumonia bout. Five of her staffers have since joined her on paid leave.

Pugh said she was going on leave on the same day Hogan asked for the investigation of lucrative sales of her “Healthy Holly” books to customers, including a major hospital network she once helped oversee as a state lawmaker and a health plan that does business with the city.

The sales earned about $800,000 for her limited liability company.

Since then, the first-term mayor has been asked to resign by the entire lineup of the current City Council, all Baltimore lawmakers in Maryland’s House of Delegates, the influential Greater Baltimore Committee business group and others. Maryland’s chief accountant called Pugh’s “self-dealing” arrangements to sell her books as “brazen, cartoonish corruption.”

But only a conviction can trigger a Baltimore mayor’s removal from office, according to City Solicitor Andre Davis and the state constitution. Baltimore’s mayor-friendly City Charter currently provides no options for ousting its executive.

“The charter is utterly silent on how long the leave can last, exactly what the reasons are for a leave,” Davis told reporters.

Members of Pugh’s communications staff have said repeatedly that she intends to return to City Hall when she is feeling better, but have declined to provide any timetable.

As multiple investigations into the mayor’s books ramp up, political analysts say Pugh’s biggest bargaining chip at the negotiating table is her refusal to resign in a city accustomed to a high-drama, insular political culture.

Pugh came to office in late 2016 after edging out ex-Mayor Sheila Dixon, who spent much of her tenure fighting corruption charges before being forced to depart office in 2010 as part of a plea deal connected to the misappropriation of about $500 in gift cards meant for needy families.

While the accusations have certainly cast a shadow over Pugh, she has not been indicted for any crime, and it is unclear how long a criminal investigation will take. Earlier this month, Silverman said the mayor looks forward to cooperating with the state prosecutor’s probe and will provide “as much information as possible to put this matter to rest.”

Pugh would certainly face a bruising 2020 Democratic primary if she were to return and run for reelection. Many political observers believe she’ll never again be able to wield power effectively due to the scandal.

A veteran City Council leader, Bernard “Jack” Young, is serving as acting mayor. Young said he would merely be a placeholder when she went on leave, and at a Wednesday news conference, he stressed that the decision is up to her. But given the groundswell of opinion against her, he said “it could be devastating for her” if she tried to return.

President Trump disputed Thursday that he had told then-White House counsel Donald McGahn to seek the firing of special counsel Robert S. Mueller III in the midst of his investigation into Russian interference in the 2016 election.

The episode, detailed in the report by Mueller that was publicly released last week, is among those being scrutinized by Democrats as they continue to investigate whether Trump sought to obstruct Mueller’s probe. In a morning tweet, Trump sought to blame the media for misreporting what happened.

McGahn emerged as a key witness in Mueller’s 448-page report, detailing several occasions when Trump ordered him to “do crazy shit,” according to the special counsel’s findings. That included trying to persuade the Justice Department to get rid of Mueller, according to the report.

McGahn didn’t, and almost resigned over the episode. He also refused to issue a public statement denying that the reports Trump wanted to fire Mueller were true when the president asked him to, the report says.

Though Trump has claimed “total exoneration” by the Mueller report, he and his aides have continued to attack Mueller and his team and aggressively dispute some of the more damaging details it contains. Trump declined to sit for an interview with Mueller in which he would have had an opportunity to rebut other testimony.

The Democratic chairman of the House Judiciary Committee issued a subpoena this week ordering McGahn to testify before the panel next month and hand over documents and records pertaining to federal investigations of Trump, his finances, his campaign and charges that he sought to obstruct justice.

In television interviews Sunday and Monday, Trump legal spokesman Rudolph W. Giuliani and former Trump lawyer John Dowd also sought to cast doubt on McGahn’s recollection of Trump’s order to seek Mueller’s firing.

Both argued that Trump wasn’t as direct as McGahn seemingly believed. Trump was only seeking to have Mueller “vetted,” Dowd said during an appearance on Fox News.

Mueller’s report did not find sufficient evidence to bring charges of criminal conspiracy with Russia against Trump or anyone associated with his campaign. It did not offer a conclusion about whether Trump obstructed justice.

Attorney General William P. Barr later concluded that there was not sufficient evidence for obstruction of justice charges, but House Democrats are continuing to aggressively pursue that issue.

Sanders gets tough reception at minority women’s event, signaling challenges ahead – The Washington Post

HOUSTON — The groans erupted halfway through Bernie Sanders’s appearance Wednesday at a presidential candidates’ forum sponsored by She the People, a group that aims to drive up voter participation among women of color.

Before an audience of about 1,700, many of them African American and Hispanic women, the moderator asked Sanders (I-Vt.) how he would handle the rise in white supremacy. Sanders spoke of fighting discrimination and running a campaign “to bring our people together around an agenda that speaks to all people” — then returned to a familiar message on universal health care.

For many in the audience, that was insufficient. “Come on!” a woman shouted from the back, as others began to jeer and boo.

The reception reflected Sanders’s struggle to win support from minority voters, a problem that dogged his 2016 primary campaign against Hillary Clinton. Sanders has taken steps since to improve his outreach, including meeting with black leaders and talking more frequently about the difficulties facing minorities, but Wednesday’s event suggested the senator still faces challenges.

Sanders at one point mentioned his long record on civil rights, but it did little to mollify the crowd.

“I was actually at the March on Washington with Dr. King back in 1963, and — as somebody who actively supported Jesse Jackson’s campaign, as one of the few white elected officials to do so in ’88 — I have dedicated my life to the fight against racism and sexism and discrimination of all forms,” Sanders said. That prompted audible groans.

Sanders may have come into the event at a disadvantage, since many black women supported Clinton in 2016. Some Clinton backers believe Sanders did too little to help her after she won the nomination.

Sanders did eventually coax a warmer reception when he vowed to use the presidential “bully pulpit” to counter hate.

Wednesday’s event, billed by organizers as the first-ever presidential forum for women of color, took place at Texas Southern University, a historically black institution in Houston, one of the most rapidly diversifying cities in the country.

Democrats hope minority voters, especially black women, will turn out in bigger numbers in 2020. Clinton won the black vote in 2016 with 89 percent to then-candidate Donald Trump’s 8 percent — but just 59 percent of registered black voters turned out. The group is a central part of the Democratic coalition.

Sanders was one of eight Democratic presidential hopefuls who appeared at the She the People forum, and the candidates sought to appeal to the attendees in various ways.

Sen. Cory Booker (D-N.J.) repeated an earlier pledge to choose a woman as his running mate. Former congressman Beto O’Rourke (D-Tex.) endorsed the Equal Rights Amendment.

Sen. Kamala D. Harris (D-
Calif.), who has faced criticism from some liberals who think she was too tough as San Francisco’s district attorney, promised to pardon low-level drug offenders if she wins the White House.

“We have to have the courage to recognize that there are a lot of folks who have been incarcerated who should not have been incarcerated and are still in prison because they were convicted under draconian laws,” Harris said.

Looming over the event was former vice president Joe Biden’s anticipated entry into the race on Thursday. Biden has close relations with many in the African American community, but some are unhappy with his treatment of Anita Hill in 1991, when she accused then-Supreme Court nominee Clarence Thomas of sexual harassment. Biden chaired the Judiciary Committee at the time and oversaw Thomas’s confirmation hearing.

Jamila Taylor, a 41-year-old policy analyst from Virginia, arrived at Wednesday’s event wearing a shirt that read, “I still believe Anita Hill.” She said that Biden had the right to seek the presidency but that his record should be a factor.

“He should be under scrutiny just like everyone else in the race,” Taylor said. “Speaking for myself, I think it was mishandled.”

Sen. Elizabeth Warren (D-Mass.) took the stage after Sanders and presented herself as a candidate of ideas. She was asked whether Democratic women might choose a male in the primary season out of concern that the broader electorate would not support a woman for president.

Warren warned against making such choices based on fear. “Are we going to show up for people that we didn’t actually believe in because we’re too afraid to do anything else?” she said. “That’s not who we are.”

The forum highlighted Democrats’ need to appeal to a diverse array of voters in 2020. Energizing liberal minority women is one key task for the party, but some Democrats say it’s equally important to appeal to centrist and even conservative voters, including those who supported Trump.

One major topic was the criminal justice system and how it treats minorities. Sanders had created a stir earlier in the week by saying that convicted criminals should be able to vote while serving prison terms.

Two other candidates, interviewed Wednesday outside the forum, took a different view.

“I would think, especially for nonviolent offenders, that we rethink removing the right to vote and allow everyone, or as many as possible, to participate in our democracy,” O’Rourke said. But he added, “For violent criminals, it’s much harder for me to reach that conclusion.”

And former San Antonio mayor Julián Castro said it makes sense to discuss the issue, but “where I would draw that line is . . . with the people who were incarcerated having the opportunity to still vote.”

White House blocks senior aide from testifying on immigration policy – ABC News

The White House has declined an invitation from the Democratic chairman of the House Oversight Committee for senior aide Stephen Miller to testify before the committee on the administration’s immigration policies, including a plan to bus migrants to “sanctuary cities.”

“In accordance with long-standing precedent, we respectfully decline the invitation to make Mr. Miller available for testimony before the committee,” White House counsel Pat Cipollone wrote in a letter obtained by ABC News.

“The precedent for members of the White House staff to decline invitations to testify before congressional committees has been consistently adhered to by administrations of both political parties and is based on clearly established constitutional doctrines.”

The White House cites a Department of Justice Office of Legal Counsel opinion which states that the president’s immediate advisers are immune from the congressional testimony process. The letter potentially provides a roadmap for how the White House plans to respond to requests for senior aides testifying before Congress.

Cummings requested that Miller come before the committee to explain the administrations’ handling of the border crisis and recent reports about a plan to transfer immigrants detained at the southern border onto the streets of “sanctuary cities” – a plan President Donald Trump confirmed.

“I am offering you an opportunity to make your case to the Committee and the American people about why you—and presumably President Trump—believe it is good policy for the Trump Administration to take the actions it has, including intentionally separating immigrant children from their parents at the border to deter them from coming to the United States, transferring asylum seekers to sanctuary cities as a form of illegal retribution against your political adversaries, and firing top Administration officials who refuse orders to violate the law,” Cummings wrote in a letter to Miller last week.

Anticipating that the White House would decline the invitation, Cummings referenced other senior White House aides who had testified, including former White House counsels and President Bill Clinton’s chief of staff.
