(CBS) –“Empire” actor Jussie Smollett, upset after a racist letter sent to the show’s studio didn’t get a “bigger reaction,” is suspected of paying two men to attack him a week later, according to multiple sources with direct knowledge of the investigation.

“When the letter didn’t get enough attention, he concocted the staged attack,” a source told CBS 2 Investigator Brad Edwards. Other sources corroborated that information.

TIMELINE:  Key Developments In The Jussie Smollett Case

FULL COVERAGE: Read CBS 2’s Coverage Of The Case

The blockbuster revelation into at least part of Smollett’s potential motive comes two days after CBS 2’s Charlie De Mar reported Smollett and two brothers — Ola and Abel Osundairo — staged the attack on Jan. 29 in Streeterville.

De Mar spoke on the phone exclusively with the Osundairo brothers Monday afternoon. In a joint statement, they said: “We are not racist. We are not homophobic and we are not anti-Trump. We were born and raised in Chicago and are American citizens.”

Smollett received a letter containing a white powder Jan. 22. The letter was mailed to Chicago’s Cinespace Studios, where the show “Empire” is filmed. The letter prompted a HAZMAT response. CPD says the “white substance” was later determined to be aspirin.

The note was crafted with letters apparently cut out from magazines to form words. The pieced-together message contained racial and homophobic threats directed at Smollett. A magazine is one of the pieces of evidence retrieved from the brother’s home last week during a search conducted by CPD. Investigators also recovered a book of stamps.

The brothers are acquaintances of Smollett.

When asked about the letter in a televised interview last week, Smollett said, “On the letter, it had a stick figure hanging from a tree with a gun pointing toward it.” It also had “MAGA” — reference to President Donald Trump’s campaign slogan Make America Great Again – written as the return address.

“In due course all the facts will reveal themselves, and at the end of the day, my clients are honest and credible,” the brothers’ attorney Gloria Schmidt said.

During the search of the brothers’ home last week, a “piece of paper/writing” was also seized. CBS 2 is the only news source with video from inside that house. Police evidence logs exclusively obtained by CBS 2, show investigators took the writing sample, magazine, and a “wallet with stamps.”

Police left behind and inventory of items taken during the raid of the home of two potential suspects in the Jussie Smollett case.

Chicago police say the FBI is handling the investigation surrounding the letter, because that’s a federal-level concern.

Smollett claims two men attacked him in Streeterville early Jan. 29 as he was heading to his apartment. He said they yelled racial and homophobic slurs at him, poured a chemical on him and put a rope around his neck.

Sources say at least one of the brothers bought the rope used in the incident at Smollett’s request. The sources also say the “Empire” actor paid for the rope, which was purchased at the Crafty Beaver Hardware Store in the Ravenswood neighborhood the weekend of Jan. 25.

Sources said one of the brothers held the rope and poured bleach while the other wore a plain red hat and yelled slurs at Smollett.

The sources say the red hat was bought at an Uptown beauty supply store and that the attack was supposed to happen before Jan. 29. The brothers told detectives the three men rehearsed the attack days prior to it happening. Smollett paid the brothers $3,500.

When Edwards reached out to CPD, immediately prior to this reporting, a spokesperson responded via text:

“We are not doing any interviews or making any official statements until we can corroborate some information that was shared with police. Until we meet with the Empire cast member, we are not able to confirm, deny or comment on any of the information that was released unofficially.

“When this investigation is over, we will have a detailed accounting of the case. While we are not in a position to confirm, deny or comment on the validity of what’s been unofficially released, there are some developments in this investigation and detectives have some follow-ups to complete which include additional investigation and speaking to the individual who reported the incident.”

In Curacao, opposition officials were buoyed by the willingness of the country’s foreign minister to stage aid along a sea corridor long used by Venezuelan migrants to flee the country. But in recent days, plans appeared to be falling apart as politicians in Curacao objected to the use of the aid as a political weapon.

The uncertainty has left some in Venezuela not counting on aid anytime soon.

“They say they are in charge of the government, but the ones who are in charge are the ones who control the bridge,” said Héctor Cárdenas, 52, who crossed the border to buys a month’s worth of cooking oil, vegetables, soap and medicines in Colombia. “The opposition has no real power.”

John R. Bolton, Mr. Trump’s national security adviser, said the United States did not plan to deploy American military personnel to deliver the aid. Instead, the plan is for it to be brought in by Venezuelan volunteers.

Regardless, the outcome would not be ideal for Mr. Maduro, Mr. Bolton told reporters in Miami before Mr. Trump’s speech.

If the Venezuelan military blocks the aid, Mr. Bolton said, the world would see Mr. Maduro’s “true colors,” Mr. Bolton said.

“We hope that the press will be there to see the Maduro loyalists stopping humanitarian assistance from going to the poor people of Venezuela,” Mr. Bolton said. “People want to know why the Venezuelan people are rising up. That act by Maduro would be proof beyond words.”

(CNN)California Attorney General Xavier Becerra is preparing to file a lawsuit challenging President Donald Trump’s national emergency declaration, Becerra told CNN’s Kate Bolduan Monday.

When ordinary people too cavalierly throw around the word “treasonous,” they devalue civil discourse and constitutional understanding. When a president wantonly uses the word, he himself is being almost, well, treasonous.

And if that second sentence above is a slight overstatement, even with the modifier “almost” included, well, it’s still a lot closer to truth and reason than it was for President Trump to tweet the accusation Monday morning at two top law-enforcement officials. Trump concluded a series of tweets by saying that Deputy Attorney General Rod Rosenstein and then-Acting FBI Director Andrew McCabe had done something “ illegal and treasonous” in questioning his fitness for office.

No, Mr. President. What they did was patriotic by some lights, and at the very least was dutiful. But what you do by your charges of “treason,” coming from the Oval Office, is to dangerously ratchet up the political temperature. The president is not a king. Opposition to him is not a crime. And mere consideration of a constitutional provision to remove him is nowhere near treason.

Trump was reacting to McCabe telling TV newsmagazine “60 Minutes” that he and Rosenstein were at least somewhat serious in wondering whether Trump was mentally fit for office, and in trying to figure out ways to ascertain the answer in a way that would be dispositive – including including a wiretap if it could be done legally. In doing so, they were in the very earliest stages of considering use of the Constitution’s 25th Amendment, a section of which allows for the removal of an incapacitated president.

It is almost inarguable that Trump acts strangely sometimes, and mercurially and rashly. It is beyond question that a spirited public debate was occurring about whether Trump was indeed mentally unfit in 25th Amendment terms. The amendment is there for good reason. Prior presidents have suffered incapacitation. Witness former President Woodrow Wilson, who suffered a stroke and was forced to rely on his wife to carry on his official duties.

The amendment is not to be used lightly, and it contains significant internal safeguards against misuse. It was a well-considered reaction by the public at large, supported by two thirds of Congress and by the legislatures of three-fourths of the states, to the assassination of former President John F. Kennedy.

To even suggest that the mere consideration of beginning a process of ascertaining a president’s mental fitness is illegal, much less treasonous, is to suggest that the 25th Amendment itself should be ignored. It is to suggest that the American people acted illegitimately in instituting the amendment, and that public officials are acting unlawfully by taking it seriously. It is to suggest that the president is a law unto himself, and that the mere act of questioning his fitness is not just a crime, but also is the single worst crime against the state itself that the Constitution recognizes.

A president holds a unique position of power. When he yells “treason,” it carries particular weight. And when he uses it to suggest that questioning him is illegitimate, he at least suggests that he is above the law.

For Trump to use the word treason in this way, as he now has done several times during his presidency, is to create a public impression which, if it takes hold, would undermine our constitutional order.

Of course, we all know that Trump tweets with abandon and often from ignorance. We know we aren’t supposed to take all his tweets literally. But that doesn’t excuse him. It just means we have even more reason to question his judgment, even if not his sanity.

The fraud allegations, and especially the sprawling inquiry that resulted, have left the Ninth District without representation in the House since early January, when the new Congress convened. Republicans have held the seat since 1963, and Mr. Harris defeated Representative Robert M. Pittenger in a primary last year.

Even in a state capital that has lately a hub of headspinning political debates, Monday’s hearing bordered on the surreal. Before the proceedings began, a young girl stood next to her mother in the cold and held a sign reading: “Thou Shalt Not Covet Thy Neighbor’s Votes!”

Inside the State Bar of North Carolina building, which hosted the hearing, the Libertarian candidate stood in the lobby to hand out news releases and offer banana walnut bread. Outside Witness Room 2 stood Mr. Dowless, his hands in the pockets of his suit. Later, when his stepdaughter testified that she had sometimes filled in uncompleted ballots, Mr. Dowless listened from near the back of the hearing room, his head bowed and eyes closed.

Regardless of the state board’s decision, the United States House of Representatives might intervene.

The House, which has the constitutional authority to be “the judge of the elections, returns and qualifications of its own members,” was closely monitoring Monday’s proceedings. Rows ahead of Mr. Dowless, and just a few yards from Mr. Harris, a man quietly observed the proceedings.

His seat was reserved for a lawyer for the House.

George Mendonsa, the man in the photo of a sailor kissing a woman in New York City’s Times Square after World War II, died at age 95.

The man in the iconic photo of an exuberant Navy sailor kissing a woman in New York City’s Times Square at the end of World War II has died.

George Mendonsa, 95, had a seizure and fell in an assisted living facility in Middletown, Rhode Island, his daughter, Sharon Molleur, told the Providence Journal. He lived there with his wife of 70 years, Rita, and died Sunday, two days short of his 96th birthday.

The photo was taken Aug. 14, 1945, which is known as V-J Day, the day Japan officially surrendered to the United States in World War II. Published in Life magazine as “V-J Day in Times Square,” it came to represent how joyful Americans and people across the world felt at the end of the war, in which 406,000 Americans died and 671,000 were wounded, according to the U.S. Census Bureau. Other commemorations of V-J Day mark Sept. 2, 1945, the Japan formally surrendered to Allied forces.

When photographer Alfred Eisenstaedt snapped the picture in 1945, he did not document any information about the photo’s subjects, and their identities were a mystery for years. Even today, people have used everything from 3D face scanning to the position of the sun in the photo to try to determine exactly whom the couple was.

Mendonsa kissed dental assistant Greta Zimmer Friedman, mistakenly thinking she was a nurse in the war because of her uniform. She came to represent the 342,000 women the Census Bureau says served in the war as pilots, nurses and more.

Friedman reached out to Life in the 1960s after seeing the photo in a book of Eisenstaedt’s photography to notify the magazine it was her in the picture. The magazine told her it was another woman until 1980 when representatives contacted her and she met with Eisenstaedt, according to an interview with the Library of Congress.

Mendonsa’s identity was verified by a 2012 book titled “The Kissing Sailor: The Mystery Behind the Photo That Ended World War II,” although some are still skeptical.

Friedman died in 2016 at 92 years old after a struggle with pneumonia. She was buried in Arlington National Cemetery with her husband.

Media captionMcCabe: “There were concerns about Trump’s intent”

US President Donald Trump has issued an angry response after a TV interview on Sunday alleged that officials had held discussions to have him removed.

Mr Trump tweeted of “illegal and treasonous” behaviour and an “illegal coup attempt”.

In the interview, ex-acting FBI chief Andrew McCabe said talks had been held in 2017 about invoking a clause that can remove a president deemed unfit.

The Senate Judiciary Committee chairman has vowed to investigate the claims.

Lindsey Graham said the claims were an “attempted bureaucratic coup”.

Mr McCabe said Deputy Attorney General Rod Rosenstein had held discussions on the number of cabinet members and others needed to invoke the clause, the 25th Amendment of the US Constitution.

How has Mr Trump responded to the claims?

In a series of tweets on Monday morning, he condemned “so many lies by now disgraced acting FBI Director Andrew McCabe. He was fired for lying and now his story gets even more deranged.

“He and Rod Rosenstein, who was hired by [then Attorney General] Jeff Sessions (another beauty), look like they were planning a very illegal act, and got caught.”

Mr Trump added: “There is a lot of explaining to do to the millions of people who had just elected a president who they really like and who has done a great job for them with the military. Vets. Economy and so much more. This was the illegal and treasonous ‘insurance policy’ in full action!”

The president quoted a comment on the Fox and Friends programme saying this was “an illegal coup attempt”, adding “True!”

The White House said Mr McCabe, who was fired last year for allegedly lying to government investigators, had “no credibility”.

The justice department said Mr McCabe’s account was “inaccurate and factually incorrect”.

    What’s the background to this?

Allegations that Mr Rosenstein discussed invoking the 25th Amendment were first reported last year by the New York Times.

However, Mr McCabe’s quotes are the first to be made on the record from someone present at the meeting where the alleged comments were reportedly made – in May 2017, after Mr Trump fired FBI director James Comey.

“The discussion of the 25th Amendment was simply [that] Rod raised the issue and discussed it with me in the context of thinking about how many other cabinet officials might support such an effort,” he said.

Mr McCabe also said Mr Rosenstein was openly “counting votes, or possible votes” and that he was “very concerned” about the president “his capacity and about his intent at that point in time.”

“To be fair, it was an unbelievably stressful time… it was really something that he kind of threw out in a very frenzied chaotic conversation.”

Mr Rosenstein has previously strongly denied having such discussions, saying there was “no basis” to invoking the amendment.

What else did Mr McCabe say?

In the 60 Minutes interview, aired on Sunday, Mr McCabe also covered allegations Mr Rosenstein had offered to secretly record Mr Trump, amid concerns about possible obstruction of justice relating to the investigation into alleged collusion between the president’s campaign team and Russia.

Rod Rosenstein previously said there was “no basis to invoke the 25th Amendment”

When the allegations first emerged in the New York Times, Mr Rosenstein said the report was “inaccurate and factually incorrect”.

A source told the BBC at the time that Mr Rosenstein’s comment “was sarcastic and was never discussed with any intention of recording a conversation with the president”.

However, Mr McCabe said that Mr Rosenstein “was not joking. He was absolutely serious”.

“It was incredibly turbulent, incredibly stressful. And it was clear to me that that stress was – was impacting the deputy attorney general.”

He added: “I never actually considered taking him up on the offer.”

    What was Sen Graham’s response?

He described Mr McCabe’s comments as “stunning” and pledged to hold a hearing at the Senate Judiciary Committee to determine “who’s telling the truth”.

Senator Lindsey Graham said he was “stunned” by the latest comments by Andrew McCabe

H said he could issue subpoenas – a court order forcing a witness to appear to give testimony – “if that’s what it takes”.

The powerful committee he chairs oversees the US judiciary.

    What is the 25th Amendment?

It provides for the removal of a president if he or she is “unable to discharge the powers and duties of office”. What this exactly means is open to interpretation.

Duties are transferred to the vice-president.

Media captionThe 25th Amendment: Could it be used to unseat Trump?

Activating the relevant section of the 25th Amendment would require the approval of eight of the 15 members of Mr Trump’s cabinet, the vice-president and two-thirds majorities in Congress.

Ronald Reagan and George W Bush used the amendment to temporarily transfer power when they were medically anaesthetised.

    Who is Andrew McCabe?

He took over as acting director of the FBI in 2017 and was himself fired as deputy director in March last year just two days before he was due to retire.

He was sacked by Jeff Sessions, who said an internal review had found he leaked information and misled investigators.

Mr McCabe denied the claims and said he was being targeted because of his involvement in the Russian collusion inquiry.

He has now written a book on his time in his posts.

One of the victims in Friday’s workplace shooting in Illinois texted his wife as he lay dying to tell her he loved her, the man’s wife said.

Josh Pinkard was one of five people killed at the Henry Pratt warehouse in Aurora by a man who police say opened fire after being terminated. Pinkard, 37, of Oswego, Ill., was the plant manager.

“I received a text at 1:24 from my precious husband that said I love you, I’ve been shot at work,” Terra Pinkard said on Facebook Sunday. “It took me several times reading it for it to hit me that it was for real.”

She said she tried to reach him — to no avail.

“I called his phone several times, text, FaceTime, nothing,” she said. “I called his plant and a lady answered and said she was barricaded in her room and police were everywhere. Of course, my heart dropped.”

AURORA SHOOTER OPENED FIRE AT TERMINATION MEETING; ONE VICTIM WAS HR INTERN ON FIRST DAY

She said that hours later she was told her husband was one of those who had been killed.

“With my pastor’s help, since my family was still on planes to get to us, I told my children their dad did not make it and is in heaven with Jesus,” Pinkard said. “I’ve never had to do something that hard.”

Pinkard said her husband was the smartest person she ever met, her best friend and “the man I would have leaned on during devastation like this.”

“The man who was dying and found the clarity of mind for just a second to send me one last text to let me know he would always love me,” she said.

Authorities said Gary Martin pulled out a gun and began shooting after being told he was being fired after 15 years for various workplace violations. Martin, 45, was killed in a shootout with officers.

President Trump on Monday accused Deputy Attorney General Rod Rosenstein and former FBI Deputy Director Andrew McCabe of pursuing an “illegal and treasonous” plot against him, after McCabe detailed private DOJ discussions about secretly recording and potentially ousting the president.

The alleged discussions have been a subject of fierce debate – and conflicting accounts – for months. But McCabe revived the issue during promotional interviews for his forthcoming book, telling CBS News’ “60 Minutes” that Rosenstein was “absolutely serious” when he suggested recording Trump in the tumultuous days following James Comey’s firing as FBI director.

FORMER TOP FBI LAWYER: TWO TRUMP CABINET OFFICIALS WERE ‘READY TO SUPPORT’ 25TH AMENDMENT EFFORT

Trump seethed on Twitter over the comments, calling McCabe a liar before lashing out at top DOJ and FBI officials, including ousted Attorney General Jeff Sessions, for what he described as a “deranged” plan.

“He and Rod Rosenstein, who was hired by Jeff Sessions (another beauty), look like they were planning a very illegal act, and got caught … There is a lot of explaining to do to the millions of people who had just elected a president who they really like and who has done a great job for them with the Military, Vets, Economy and so much more. This was the illegal and treasonous ‘insurance policy’ in full action!” he tweeted.

“Insurance policy” is a reference to texts between former FBI officials Peter Strzok and Lisa Page discussing such a policy, without elaborating – the text was widely suspected of referring to aspects of the Russia collusion probe.

While Trump fumed at McCabe, the former FBI deputy director claimed he “never actually considered taking [Rosenstein] up on the offer.” He said he did discuss the matter with the FBI’s then-general counsel, James A. Baker. Last fall, as reported by Fox News, Baker told lawmakers during a closed-door deposition that McCabe and Page came to Baker “contemporaneously” and told him details of the meeting where Rosenstein made the comments. Baker told congressional investigators he took the word of McCabe and Page “seriously.”

McCabe told CBS News that “I think the general counsel had a heart attack” when he told him of Rosenstein’s plan.

“And when he got up off the floor, he said, ‘I, I, that’s a bridge too far. We’re not there yet,'” McCabe added. Days later, Rosenstein appointed former FBI Director Robert Mueller as a special counsel to oversee the bureau’s investigation into allegations of collusion between the Trump campaign and Russian officials.

MCCABE SAYS ROSENSTEIN SERIOUS ABOUT RECORDING TRUMP

Rosenstein repeatedly has denied he “pursued or authorized recording the president” and also has denied McCabe’s suggestion that the deputy attorney general had broached the idea of invoking the Constitution’s 25th Amendment, which allows Cabinet members to seek the removal of a president if they conclude that he or she is mentally unfit. The Justice Department echoed both denials in a statement released last week, saying Rosenstein “was not in a position to consider invoking the 25th Amendment.”

Yet McCabe said in the interview, “Rod raised the [25th Amendment] issue and discussed it with me in the context of thinking about how many other Cabinet officials might support such an effort.” He added that he believed Rosenstein was “counting votes or possible votes” to remove Trump from office.

Fox News reported Sunday that Baker, in his testimony to Congress, provided even more details about the alleged 25th Amendment discussions – saying two Cabinet officials were “ready to support” such an effort.

“I was being told by some combination of Andy McCabe and Lisa Page, that, in a conversation with the Deputy Attorney General, he had stated that he — this was what was related to me — that he had at least two members of the president’s Cabinet who were ready to support, I guess you would call it, an action under the 25th Amendment,” Baker testified.

The parliamentary report recommends the creation of a British watchdog to oversee the technology industry, similar to the country’s approach to regulating media companies. It also suggested legally requiring Facebook and other large internet platforms to remove what the government determines to be harmful content, or risk fines or other punishments.

Silicon Valley has long opposed making tech companies responsible for content on their sites. The industry argues that websites like Facebook, YouTube and Twitter are simply unbiased platforms for others to share material, and that new restrictions could impede free speech.

“Social media companies cannot hide behind the claim of being merely a ‘platform’ and maintain that they have no responsibility themselves in regulating the content of their sites,” the parliamentary report said.

Facebook acknowledged past mistakes and said it was open to “meaningful regulation.”

“While we still have more to do, we are not the same company we were a year ago,” said Karim Palant, a public policy manager for Facebook in Britain. “We have tripled the size of the team working to detect and protect users from bad content to 30,000 people and invested heavily in machine learning, artificial intelligence and computer vision technology to help prevent this type of abuse.”

The blistering report concludes the committee’s work, which started as a study of how social media can be manipulated to influence elections like Britain’s 2016 vote to exit the European Union, but became a closer examination of Facebook business practices. The committee held several hearings related to Facebook’s relationship with Cambridge Analytica, the voter-targeting firm that gained access to 87 million Facebook users.

If Congress votes to disapprove Trump’s declaration of a national emergency, the president is prepared to veto it, White House senior adviser Stephen Miller said on Sunday.

The president is declaring a national emergency to secure up to $8 billion in funding for a barrier on the southern border — more than four times what Congress approved. House Democrats have called Trump’s declaration unlawful, and are considering a joint resolution disapproving of the declaration. Miller’s comments during a Fox News interview made it clear the president is unlikely to back down.

“If they pass a resolution of disapproval, will the president veto that, which would be the first veto of his presidency?” Fox News host Chris Wallace asked.

“Well obviously the president is going to protect his national emergency declaration,” Miller responded.

“So yes, he will veto?” Wallace pressed.

“He’s going to protect his national emergency declaration, guaranteed,” Miller said.

A resolution of disapproval would let Congress overturn Trump’s declaration and would likely pass in the Democratically controlled House of Representatives. But it would face uncertainty in the Senate, where multiple Republican lawmakers would have to join with Democrats in the minority. Illinois Sen. Tammy Duckworth told ABC’s This Week that she believes the Senate has enough votes for such a resolution.

“I think we do,” she said. “Now, whether we have enough for an override and veto, that’s a different story. But frankly, I think there’s enough people in the Senate who are concerned that what he’s doing is robbing from the military and the DOD to go build this wall.”

If Trump vetoes the resolution, Congress would need a two-thirds majority in both houses to override — unlikely, given the current political makeup of the chambers. If Congress were unable to override a Trump veto, Duckworth said the House should sue based on the argument that only Congress has the power to appropriate funds.

Trump is already facing several legal challenges, including one promised by California Attorney General Xavier Becerra arguing that the state will be harmed when Trump diverts funds for a wall.

Trump may have hurt his own case when he said during his announcement Friday: “I could do the wall over a longer period of time. I didn’t need to do this. But I’d rather do it much faster.” As NPR national political correspondent Mara Liasson explained on Weekend Edition Sunday, Trump “really undercut himself in that speech in the Rose Garden” when he said the emergency wasn’t needed. “In other words, he’s doing this for expedience, not necessity.”

Presidents have invoked emergency powers for decades, but this is the first time one has used an emergency to secure funding for a project that Congress has explicitly declined to fund, The New York Times reports.

Sen. Lindsey Graham, R-S.C., vowed Sunday to investigate alleged discussions at the Department of Justice about invoking the 25th Amendment as a way to oust President Trump from office and threatened to subpoena former FBI Deputy Director Andrew McCabe if he refused to testify on the matter before the Senate.

“We’re going to find out what happened here and the only way I know to find out is to call the people in under oath and find out, through questioning, who’s telling the truth because the underlying accusation is beyond stunning,” Graham, the chairman of the Senate Judiciary Committee, said on CBS News’ “Face the Nation.”

Graham added that he also plans to subpoena both McCabe and Deputy Attorney General Rod Rosenstein if they won’t voluntarily agree to testify before the committee.

“There is no organization beyond scrutiny,” Graham said. “There is no organization that can’t withstand scrutiny. And the FBI will come out stronger.”

ANDREW MCCARTHY: MCCABE, ROSENSTEIN AND THE REAL THRUTH ABOUT THE 25TH AMENDMENT COUP ATTEMPT

He said: “But we’ve got to get to the bottom of it. What are people to think after they watch “60 Minutes” when they hear this accusation by the acting deputy — acting FBI director that the deputy attorney general encouraged him to try to find ways to count votes to replace the president? That can’t go unaddressed.”

Graham’s comments come on the heels of a Fox News story that reported that former FBI lawyer James Baker, in closed-door testimony to Congress, detailed alleged discussions among senior officials at the Justice Department about invoking the 25th Amendment.

The testimony was delivered last fall to the House Oversight and Judiciary Committees. Fox News has confirmed portions of the transcript. It provides additional insight into discussions that have returned to the spotlight in Washington as fired FBI Deputy Director Andrew McCabe revisits the matter during interviews promoting his forthcoming book.

Baker did not identify the two Cabinet officials. But in his testimony, the lawyer said McCabe and FBI lawyer Lisa Page came to him to relay their conversations with Rosenstein, including discussions of the 25th Amendment.

“I was being told by some combination of Andy McCabe and Lisa Page, that, in a conversation with the deputy attorney general, he had stated that he — this was what was related to me — that he had at least two members of the president’s Cabinet who were ready to support, I guess you would call it, an action under the 25th Amendment,” Baker told the committees.

Graham’s comments on Sunday come after he floated the idea of a subpoena last week in a comment to Fox News about the Justice Department discussions.

“I would like to know what happened,” Graham told Fox News. “You’re having a conversation about whether or not you’re going to invoke the 25th Amendment. I imagine if the shoe were on the other foot, my Democratic colleagues would want to know about that conversation if it involved a Democrat.”

CBS News reported on McCabe’s comments after he told “60 Minutes” that Justice Department officials discussed the possibility of removing Trump via the 25th Amendment and that Deputy Attorney General Rosenstein had offered to wear a wire around the president.

The 25th Amendment provides a mechanism for removing a sitting president from office. One way that could happen is if a majority of the president’s Cabinet says the president is incapable of discharging his duties.

Since giving the interview to “60 Minutes,” McCabe has since made an about-face, with a spokesperson for the former FBI chief releasing a statement that says McCabe did not “participate in any extended discussions about the use of the 25th Amendment, nor is he aware of any such discussions.”

The Justice Department issued a statement calling McCabe’s comments “inaccurate and factually incorrect.”

Reports of the discussions of invoking the 25th Amendment and of Rosenstein wearing a wire were reported in The New York Times.

Former FBI Deputy Director Andrew McCabe condemned what he called the “relentless attack” that President Trump has waged against the FBI even as it continues scrutinizing whether Americans in Trump’s campaign may have conspired with the Russians who attacked the 2016 election.

“I don’t know that we have ever seen in all of history an example of the number, the volume and the significance of the contacts between people in and around the president, his campaign, with our most serious, our existential international enemy: the government of Russia,” McCabe told NPR’s Morning Edition. “That’s just remarkable to me.”

McCabe left the FBI after 21 years last March, when he was dismissed for an alleged “lack of candor” in a media leak probe unrelated to the special counsel investigation.

While he declined to conclude that Trump or his advisers colluded with Russia, McCabe said the evidence special counsel Robert Mueller has made public to date — including new disclosures about an August 2016 meeting between former campaign chairman Paul Manafort and Konstantin Kilimnik, whom the FBI has linked to Russian intelligence — “is incredibly persuasive.”

Trump goes back and forth about what he accepts about the Russian interference in the 2016 election but he denies that he or anyone on his campaign colluded with it.

The president and the White House also have focused their attention on McCabe’s firing and what critics call the conflict of interest involved with McCabe’s wife’s political campaign — she ran unsuccessfully for the Virginia legislature as a Democrat.

    The Putin presentation

McCabe’s new book, The Threat: How the FBI Protects America in the Age of Terror and Trump, describes the challenges and frustrations in interacting with the new president on sensitive national security matters.

Exhibit A: an FBI briefing with Trump that had “gone completely off the rails from the very beginning.”

McCabe said the topic was supposed to be how Russian intelligence officers were using diplomatic compounds inside the U.S. to gather intelligence on American spy agencies. Those compounds were closed as part of the long diplomatic chill between the two countries.

“Instead the president kind of went off on a diatribe,” McCabe told NPR, explaining that Trump changed the subject to his belief that North Korea had not actually launched any missiles because Russian President Vladimir Putin told him that the U.S. intelligence assessment was wrong and that “it was all a hoax.”

The president, in short, was taking the word of Putin over his own top advisers.

“How do we impart wisdom and knowledge and the best of our intelligence assessments to someone who chooses to believe our adversaries over our intelligence professionals?” McCabe asked.

    The investigations

McCabe became the FBI’s acting director after his former boss, former Director James Comey, was fired in the spring of 2017. He returned to the deputy director role after Director Christopher Wray was confirmed that autumn.

McCabe confirmed that he opened counterintelligence and obstruction of justice investigations into Trump after Comey was fired but said he and Justice Department leaders ultimately rejected the idea of secretly recording the president.

FBI employees were crying in the hallways, McCabe writes in his book. No one knew whether Trump — whose campaign was being investigated about conspiring with Russia — might have been trying to decapitate the leaders of the investigation aimed at trying to find out what might be beneath it all.

The atmosphere at the Justice Department was so panicked, McCabe said, that the new deputy attorney general, Rod Rosenstein, proposed wearing a recording device to collect evidence about Trump’s intent in dismissing Comey.

“I was taken aback by the offer,” McCabe said in his NPR interview. “I told him that I would consider it, I would discuss it with the investigative team, and I’d let him know. I did talk to my attorneys back at FBI headquarters about it.”

When that story became public last year via a news report, Rosenstein was embarrassed and feared for his job. He also sought to make clear that he never actually went ahead with a secret recording — which is correct, McCabe said, because no one involved ever tried to attempt it.

“We all agreed it was a horrible idea and it was not something that we would pursue,” McCabe said. “So while the deputy attorney general says he never authorized anyone to wear a wire, that is true — he never authorized it because we never asked him for that authorization.”

McCabe says he was wrongly fired

On his own firing, just 26 hours before his federal law enforcement pension was set to vest, McCabe said he intends to sue the Trump administration for wrongful termination and other issues.

A man who fell in love with the FBI is now the subject of an ongoing criminal investigation for alleged false statements. A grand jury has been impaneled in the case but it isn’t clear whether prosecutors will bring criminal charges.

McCabe refused to engage in his NPR interview over findings by the Justice Department’s inspector general, calling that report a “selective presentation of evidence and conclusions designed to reach the result the president was clearly calling for.”

Since the publication of excerpts and interviews surrounding McCabe’s book have emerged, Trump has been tweeting to attack McCabe’s credibility.

That’s just more evidence, argued the former deputy FBI director, that he was singled out then and he’s being singled out now.

But that’s not just bad for him, he argued.

“The thing that concerns me going forward is firing me 26 hours before my retirement sends an unbelievably chilling message to the rest of the men and women of the FBI,” McCabe said.

“It sends a message that if you stand up for what you think is right, and you do the right thing, and you honor your obligations to this organization and the Constitution, that you too could be personally targeted and lose those things that you’ve been building towards your whole career.”

A sixth grader in Florida was arrested after his refusal to participate in the Pledge of Allegiance escalated into a confrontation with police and school officials, authorities said.

The unnamed boy was charged with disrupting a school function and resisting an officer without violence on Feb. 4, the Lakeland Police Department said in a news release.

A local news outlet, Bay News 9, reported that the confrontation began after the student at Lawton Chiles Middle Academy, near Tampa, called the flag racist and described the national anthem as offensive.

Citing a statement provided to the Polk School District by the boy’s substitute teacher, the station reported that the teacher asked him, “why if it was so bad here he did not go to another place to live.”

“They brought me here,” the boy replied, according to the statement.

After the teacher told him he could “always go back,” she called the school’s office “because I did not want to continue dealing with him,” the station reported.

The district did not respond to a request for comment on Sunday, but a school spokesman told the Ledger, a local newspaper, that students are not required to participate in the pledge.

The spokesman, Kyle Kennedy, told the newspaper that the teacher, Ana Alvarez, wasn’t aware of that policy and would no longer work with the district.

The boy’s mother, Dhakira Talbot, could not immediately respond to an interview request on Sunday, but she told Bay News 9 that Alvarez’s response “was wrong.”

“She was way out of place,” Talbot said, according to the station. “If she felt like there was an issue with my son not standing for the flag, she should’ve resolved that in a way different manner than she did.”

After the confrontation began, the school’s dean of students tried unsuccessfully to calm the student down, asking him to leave the class 20 times, police said.

“The school resource officer then intervened and asked the student to exit the classroom and he refused,” the department said. “The student left the classroom and created another disturbance and made threats while he was escorted to the office.”

According to Bay News 9, the student denied making threats.

The Lakeland Police Department said in a statement that the boy was not arrested for refusing to stand for or recite the Pledge of Allegiance. “This arrest was based on the student’s choice to disrupt the classroom, make threats and resisting the officer’s efforts to leave the classroom.”

“I want the charges dropped and I want the school to be held accountable for what happened because it shouldn’t have been handled the way it was handled,” Talbot said.

BERLIN (Reuters) – Germany can take back Islamic State fighters captured in Syria only if the suspects have consular access, the interior ministry said on Sunday, playing down the likelihood of Berlin meeting demands made by U.S. President Trump to his European allies.

With U.S.-backed fighters looking poised to defeat Islamic State in Syria, Trump on Saturday called on Britain, France and Germany to take back more than 800 captured Islamic State fighters and put them on trial.

“In principle, all German citizens and those suspected of having fought for so-called IS have the right to return,” said a spokeswoman for Germany’s interior ministry, adding, however, that the condition for that was consular access for suspects.

She said Iraq had shown an interest in having some IS fighters from Germany put on trial. “But in Syria, the German government cannot guarantee legal and consular duties for jailed German citizens due to the armed conflict there,” she said.

Some 1,050 people have traveled from Germany to the war zone in Syria and Iraq since 2013 and about a third have already returned to Germany, according to German authorities.
