CHICAGO (CBS) — A massive fire early Monday morning in the Albany Park neighborhood destroyed two businesses and an apartment building, injuring one person and leaving several others homeless.

READ MORE: Fire Rips Through Apartment Building On West Side Of Evanston

More than 150 firefighters responded to the blaze at the corner of Montrose Avenue and Richmond Street.

Fire Department officials believe the fire started around 3:30 a.m. in a 3-story apartment building at 4337-39 N. Richmond St., and then spread to the neighboring building at the southeast corner of Richmond Street and Montrose Avenue – which housed Twisted Hippo Taproom and Eatery, and Ultimate Ninjas gym.

The fire burned for several hours as firefighters worked to contain the flames. Neighbors reported hearing explosions.

Five hours after the fire started, firefighters were still pouring water on the building from above and below, calling it a “surround and drown” tactic, but crews had to be careful to stay away because of the danger.

“The building itself is a one-story truss roof. To us, it is the most dangerous type of building to fight. So precautions are taken, collapse zones are set up,” said Chicago Fire Department Deputy District Chief Thomas Carbonneau.

Several cars were left buried under rubble after part of the roof and a large section of the rear wall of the Twisted Hippo collapsed.

Late Monday afternoon, it was still not confirmed where the fire started. But the damage at the scene hours later showed just how fast the fire spread.

Five people were left without a home because of the fire at the apartment building, and what was left of the neighboring building that housed the two businesses will need to be torn down.

Marilee Rutherford, the owner of the Twisted Hippo Brewery, which is now in rubble, spoke earlier to CBS 2’s Marissa Parra as she watched her business continue to burn.

She said she was given the news by her husband, who was called by a community member overnight. When she arrived on the scene, her business engulfed in flames. She said the cause of the explosions might have been the CO2 and nitrogen tanks used for dispensing draft beer.

“We have CO2 and nitrogen tanks, just as a regular part of our business, and I’m certain that’s what the explosions were,” Rutherford said.

She said her focus is on the safety of her staff and the community.

“It’s hard to see everything you worked for go up in flames, but I’m just glad my staff and everyone is okay. That’s all I’m focused on,” Rutherford said.

The brewery opened in 2019, and Rutherford said the goal was to create a “light, bright, warm, and inviting space, with a little bit of something for everyone” in the community.

“I think we have done that, but we’ll just have to see how we move forward,” she said.

The Illinois Craft Brewers Guild has set up a GoFundMe page to help the Twisted Hippo and their staff with recovery costs. The page has already raised more than $54,000 towards its $100,000 goal in just the first four hours since it was set up.

The destruction of Ultimate Ninjas is also a big loss for the community. It’s been around for years, and does a lot of work with children. They had camps scheduled for Monday, and were expecting 90 kids to show up, but now both the gym and Twisted Hippo are both a total loss.

Ultimate Ninjas owner Jeff Piejak called it terrible timing for both businesses.

“That’s the sad part is we really brought a lot of life to this area, and it really needed it. You know, Albany Park really kind of needed something like this to come and fill the neighborhood full of kids,” Piejak said. “It’s not going to be easy to find a similar location, but yeah, we’ll be back.”

Fire Department officials said the fire was struck out around 8:30 a.m., but crews would remain on the scene for several hours to douse hotspots, and prevent the fire from flaring up again. The rest of the building that housed the brewery and gym also will need to be demolished. The neighboring apartment building also was gutted.

The massive fire also affected hundreds of neighbors, as ComEd had to cut off power to about 350 homes and businesses so firefighters could safely fight the fire. Power has since been restored for 228 ComEd customers, and ComEd is waiting for the green light from the Fire Department to restore power to the rest.

Paris Wadhwa said he has been without power and heat since around 4 a.m.

“I have a baby, and a little girl, we’re trying to them in the house, and making sure that they are warm,” he said. “The cooking gas is working, so that’s a good thing, but there’s no heat and no electricity. So we’re hoping that the power comes back on.”

Wadhwa said he was told power should be restored by 12:30 p.m., but he’s really hoping it will be back sooner.

Police said a 60-year-old man was taken to a local hospital for possible smoke inhalation. Several other residents of the apartment building were able to escape safely. The Red Cross is on the scene, assisting five people displaced by the fire.

São Paulo – After a three-year period closed for its first full renovation, the Immigration Museum (Museu da Imigração, in Portuguese) will open its doors for the public again on May 31st. Restored and adapted to receive the public, the museum will now hold a permanent exhibition on the 2.5 million immigrants and migrants who have passed through it, besides documents, temporary exhibits and a space for research.

Press release/Immigration Museum

Prospect of the new exhibition: tour will have video and projections

The repairs in the Immigration museum cost around US$ 9 million and were intended to adapt the building to host the museum’s public and collections. Built in 1887 to function as an inn, the building will have air conditioning, flood gates and adaptations for people with special needs. The building was repaired and even the institution’s name has changed from Immigrant’s Memorial to Immigration Museum.

According to the executive director, historian Marília Bonas, the museum which will be reopened to the public will not only touch on early 19th century immigration, but on current immigration as well. “The curatorship has striven to expand the immigrants’ speech. We want to discuss the multiple voices of those who have passed through here to share the immigrants’ experience”, Bonas told ANBA. She also said that the institution will dialog with the immigrant communities and will have a “strong aspect of partnership” with society.

The new permanent exhibition will recall the old facilities of the Immigrants’ Inn. It will have eight modules which promise to have visitors immerse themselves in the Inn’s daily life. In one of the modules, the visitor will be “taken” to the cafeteria and hear the immigrants speak in several languages. From there, they will move on to the dorms, where they will be shown the expectations and dreams of the immigrants before they actually lived in Brazil. They will also watch videos with testimonies from former guests. Other modules will show immigration nowadays.

The Immigration Museum will have an auditorium, a cafe and a space for research on the topic. Visitors who want to use the library and the reference and research center will be accompanied by a museum employee. School groups will have a space to do activities and workshops connected to the theme of immigration.

History

The Immigrants’ Inn was opened to receive immigrants who came to Brazil to work. The first guests were Europeans who left their countries invited by the government of São Paulo after slavery was abolished. They came to replace slaves in the coffee crops. These employees came to Brazil by ship, with the tickets paid by the government of São Paulo. They disembarked in the port in Santos, went up the mountain by train and were hosted at the inn before being sent to work in the countryside.

Press release/Museu da Imigração

Building has the history of 2.5 million people

As the years passed by, the inn received immigrants of over 70 nationalities, among them Syrians and Lebanese. Brazilian people who came to São Paulo were also hosted there in the 1930s. “In the case of Arabs, they came from many places and focused on urban centers and commerce. Portraying Arab culture is a challenge because it is composed of many cultures and we are interested in bringing that to the public”, says the executive director.

After the closing of the Immigration Museum, its management has also changed. The institution belongs to the State Secretariat for Culture, but is run by the Social Cultural Organization for Friends of the Coffee Museum (Organização Social de Cultura Associação dos Amigos do Museu do Café, in Portuguese), which also runs the namesake museum in Santos, on São Paulo’s shore. The managers expect the Immigration Museum to have 500,000 visitors by the end of the year.

For the opening day, immigrant community theatre presentations and dance shows are scheduled, besides a concert by songwriter and singer Arnaldo Antunes. In June and July, the entrance is free. Besides the permanent exhibition, the Immigration Museum will host temporary exhibits.

At Tuesday’s White House coronavirus press briefing, President Donald Trump got into an argument with Reuters correspondent Jeff Mason, when he commanded him to take off his protective face mask.

Mason refused to do so, at which point Trump mocked him, saying “You want to be politically correct.”

Trump also repeated a line previously made by his press secretary Kayleigh McEnany, asking why former Vice President Joe Biden wore a mask when he was in public but not standing close to anyone, when he wasn’t wearing a mask at home with his wife right next to him.

Muslim women have been banned from wearing face veils under an emergency law passed by Sri Lanka‘s president, days after more than 250 people were killed in series of bombings in the country’s capital Colombo.

Maithripala Sirisena‘s office said any garment or item which obstructs the identification of a persons face would be barred.

The move follows recent cabinet discussions on face coverings. The government had said it would delay a decision until talks with Islamic clerics could be held, on the advice of prime minister Ranil Wickremesinghe.

A week after the attack on Easter Sunday, the country’s Catholic churches remained closed because of security fears.

However, Mr Sirisena and Mr Wickremesinghe attended a televised Mass at the residence of Cardinal Malcolm Ranjith, the archbishop of Colombo.

“This is a time our hearts are tested by the great destruction that took place last Sunday,” Mr Ranjith told those watching across the nation. “This is a time questions such as, does God truly love us, does he have compassion towards us, can arise in human hearts.”

Police said they had arrested 48 suspects over the last 24 hours as checkpoints were mounted by all of Sri Lanka’s security forces across the country.

Among those detained were two men whom authorities recently appealed to the public to locate.

Tensions have been running high on the island over the past week, with fears of further attacks as well as dread over possible retaliation against Sri Lanka’s Muslims.

Police entered the main mosque of National Towheed Jamaat (NTJ) in Kattankudy on Sunday afternoon, just a day after authorities declared that it was a terror group.

Authorities have banned NTJ over its ties to Mohammed Zahran, the alleged mastermind of the attacks which also left hundreds wounded.

Zahran and others wearing masks, had pledged their loyalty to Isis leader Abu Bakr al-Baghdadi before carrying out the attacks.

Later, an officer dispersed journalists waiting outside, saying authorities were conducting a “cordon and search operation.”

Police then left, locking up the mosque just before afternoon prayers were to start.

Earlier this week a Sri Lankan parliamentarian proposed a ban on women wearing the burqa.

Ashu Marasinghe submitted a motion to parliament stating that the garment, which covers the whole body and the face, was “not a traditional Muslim attire” and should be outlawed on security grounds.

On Friday night, a confrontation with police sparked a firefight with militants in Kalmunai. Sri Lanka’s military said the gunfire and later suicide blasts killed 15 people, including six children.

Isis clater laimed three of the militants who blew themselves up there, identifying the bombers by their noms du guerre as Abu Hammad, Abu Sufyan and Abu al-Qa’qa.

Police spokesman Ruwan Gunasekara confirmed a woman and a four-year-old child found wounded after the gunbattle have been identified as Zahran’s wife and daughter.

The Isis-aligned militants had created a bomb-making factory at the home. Bags of fertiliser, gunpowder and small ball bearings filled boxes. Police found fuels used to make the fire of the blast more lethal.

LOUISVILLE, Ky. — Mayor Greg Fischer announced Friday that Louisville Metro Police is initiating termination of Officer Brett Hankison, one of three LMPD officers to fire weapons on March 13 at Breonna Taylor’s apartment, killing her.

Hankison is accused by the department’s interim chief, Robert Schroeder, of “blindly” firing 10 rounds into Taylor’s apartment, creating a substantial danger of death and serious injury.

“I find your conduct a shock to the conscience,” Schroeder wrote in a Friday letter to Hankison laying out the charges against him. “I am alarmed and stunned you used deadly force in this fashion.”

“The result of your action seriously impedes the Department’s goal of providing the citizens of our city with the most professional law enforcement agency possible. I cannot tolerate this type of conduct by any member of the Louisville Metro Police Department,” he added. “Your conduct demands your termination.”

Officials identified Aminadab Galaxio Gonzalez as the man who allegedly opened fire at a Southern California office building, killing four people, including a child.

The shooting happened at 5:30 p.m. on Wednesday, and officers arrived as shots were being fired. An officer-involved shooting occurred and the suspect was wounded, although it’s unclear if it was self-inflicted or from an officer. He was transported to a hospital and in critical condition.

Gonzalez, 44, is from Fullerton, according to Lieutenant Jennifer Amat. Officials believe the shooting was motivated by personal and business relationships that existed between the suspect and the victims.

If convicted, Gonzalez would be eligible for the death penalty, according to Orange County District Attorney Todd Spitzer, who said this was a special circumstance case.

Law enforcement officials said Gonzalez allegedly used a bike lock to hold the gates closed, requiring officers to bring bolt cutters to the scene to gain entry. The District Attorney’s office is looking into whether the locking of the gates constitutes a “lying in wait,” which also is punishable by the death penalty.

Aminadab Gaxiola Gonzalez, 44, was identified as the suspect of a Wednesday shooting in Orange, California.
Orange Police Department

When officers arrived on the scene, they found multiple victims. Along with the four people who lost their lives, a fifth victim was injured during the shooting and transported to a hospital in critical condition.

“It appears a little boy died in his mother’s arms as she was trying to save him during this horrific massacre,” Spitzer said.

Paul Tovar told KABC he was trying to find out about his well-being of his brother, who owns a business in the building and wasn’t answering his phone. Tovar was “pretty scared and worried” and said he was “just praying really hard.”

Another witness told KABC they heard five to seven gunshots, then heard more gunshots go off a few minutes after police arrived. Neighbors initially thought it was a car backfiring but when it became louder, they realized it was gunfire.

A firearm was located on the scene, according to Amat, and multiple agencies were on the scene on Wednesday to help with the investigation. Amat said it could take days or even weeks to obtain information on any relationship the suspect had with the victims.

Law enforcement identified the suspect in the Orange, California, shooting that left four people dead, including a child. A police officer keeps watch at an office building where four people, including a child, were killed in a shooting on Wednesday in Orange, California.
Mario Tama/Getty Images

“Orange is a very safe city and we don’t have stuff like this that happens very often,” Amat said. “It’s been many, many years before we’ve had an incident like this happen.”

It’s the deadliest shooting in Orange since 1997, according to police, when a 43-year-old former Caltrans worker shot and killed four of his former coworkers.

This latest incident comes on the heels of deadly shootings in Boulder, Colorado, and the Atlanta area, prompting calls for Congress and President Joe Biden to take action on gun control.

House Democrats sent a letter to Biden urging him to take executive action to regulate concealable firearms similar to the one that the Boulder suspect used to kill 10 people. The Ruger AR-556 pistol isn’t a rifle, but it resembles one and can fire rifle rounds.

The White House is considering taking executive action on gun control, with Press Secretary Jen Psaki saying on Tuesday the administration was “working on a couple of levers.” One is to work with Congress, and Psaki said they’ve seen an openness from Republicans to have a “debate and discussion.”

Biden told reporters he was “of course” prepared to make calls to Republicans to help move legislation forward. He defended his record on gun control, saying “the only gun control legislation ever passed was mine” and that “it’s going to happen again.”

Paul Flores killed Kristin Smart in his college dorm room as he sexually assaulted the 19-year-old student, prosecutors alleged Wednesday.

The grim details of how Smart is believed to have died while a freshman at Cal Poly San Luis Obispo came on a day when Flores was formally charged with first-degree murder in the case and accusations surfaced that he has assaulted other women in the decades after allegedly killing Smart.

Los Angeles Police Capt. Jonathan Tippet, head of the agency’s Robbery-Homicide Division, said detectives in recent months gathered evidence against Flores in three sexual assaults that allegedly occurred over several years.

Detectives, according to Tippet, presented their findings to the L.A. County district attorney’s office for criminal charges against Flores, although a D.A. spokesman said the office has not conducted a formal review of the cases. The spokesman said prosecutors did review a rape allegation against Flores brought by Redondo Beach police in 2013, but declined to charge him “due to insufficient evidence.”

In announcing the murder charge against Flores, San Luis Obispo County Dist. Atty. Dan Dow acknowledged authorities remain interested in those alleged earlier attacks, saying his office is looking into whether Flores sexually assaulted other women in San Pedro, an area of Los Angeles where he has lived since about 2005.

And Dow claimed his office has evidence that an unspecified number of victims have had “some kind of a criminal act perpetrated on them by Mr. Flores.” Saying Flores was known to frequent bars in the San Pedro area, the district attorney asked that women who may have been assaulted by Flores contact San Luis Obispo authorities.

Paul Flores, long described as a ‘prime suspect,’ was taken into custody by San Luis Obispo County sheriff’s officials

Flores, 44, was arrested Tuesday at his home, nearly 25 years after Smart left a party near the Cal Poly campus and vanished on the way back to her campus dormitory.

From the start, investigators focused their attention on Flores, a classmate of Smart’s and the last person seen with her. Two students told the police they had left the party with Smart when Flores appeared and promised to see her back to her dormitory.

Over the years, San Luis Obispo authorities called Flores a “person of interest,” then a “suspect,” then a “prime suspect.” They searched his homes. They searched his parents’ homes. They called him before a grand jury, tapped his cell phone and read his text messages. But hamstrung by their inability to find Smart’s body, they stopped short of accusing him of the killing.

The arrest comes nearly 25 years after Smart vanished while walking back to her dorm at Cal Poly San Luis Obispo.

Dow said prosecutors decided they could prove Flores’ guilt after investigators discovered more evidence and interviewed new witnesses in the last two years. He declined to provide specifics, saying only that text messages taken from Flores’ phone had been “helpful” and that detectives obtained “very important” information in March. Investigators that month searched a home owned by Flores’ father with cadaver dogs and ground-penetrating radar.

“We’ve got physical evidence,” Dow said, “we have witness statements, things that, in our view, in their totality, have brought us to the point where we believe we can go forward and prosecute Mr. Flores for the murder of Kristin Smart.”

Dow declined to say how Smart died or why investigators now believe the killing occured in Flores’ dormitory room while he raped or attempted to rape Smart.

Flores’ father, Ruben Flores, 80, was also charged Wednesday as an accessory to Smart’s murder. He is accused of helping his son dispose of Smart’s remains.
Both men have yet to enter a plea and are due to be arraigned Thursday morning in San Luis Obispo Superior Court.

Despite numerous investigations, searches and legal procedures, it took 24 years for an arrest to be made in the disappearance of Kristin Smart.

The whereabouts of Smart’s body remain a mystery. On Wednesday, Dow said “we do believe we have the location where the body was buried,” but would not elaborate. Authorities have not found Smart’s remains and are continuing to search for them, Sheriff Ian Parkinson said Tuesday.

Dow said it was “premature to even speculate” whether his office would consider offering Paul Flores some leniency if he would reveal where Smart’s remains are now.
If Smart’s remains are not found, Dow’s prosecutors will face the challenge of proving to a jury that a murder and cover-up occurred without being able to show definitively that Smart was killed. Dow called the task “obviously complicated and difficult” but not impossible, pointing to a recent conviction won by his office in the murder of an elderly woman whose remains were never recovered.

Such no-body prosecutions, Dow said, are “incredibly important for the victim’s family because they want closure.”

One warm Friday night in late spring 10 years ago, Kristin Denise Smart and three other young women started walking from their dorms at Cal Poly San Luis Obispo.

Dow was asked at the news conference if any other member of Flores’ family could be charged in Smart’s killing, specifically his mother. His office had insufficient evidence to bring charges against anyone else, he said, but added that the investigation was continuing.

“If it were to lead to other suspects,” he said, “we will follow that evidence when it becomes available.”

Powerball’s top prize has surged yet again, vaulting it into the top 10 largest jackpots in U.S. lottery history.

With no one matching all six numbers drawn Wednesday night, the jackpot is now an estimated $620 million for Saturday night’s drawing. If there’s a winning ticket, it would be the 10th-largest lottery prize won — and still $980 million behind the largest ever: a $1.6 billion Powerball prize won in January 2016.

The jackpot has been growing since early June when a single ticket sold in Florida won $286 million. Since then, there have been 38 drawings with no grand prize winner.

The cash value — which most winners choose instead of an annuity spread over 30 years — for this $620 million jackpot is $446 million. That amount would be reduced by a 24% federal tax withholding of about $107 million, as well as any state taxes due. And, more would likely be owed to the IRS at tax time.

Despite the sizeable share that goes to taxes, the windfall would be more than most people see in a lifetime. This makes it important for winners to get professional guidance before heading to lottery headquarters. Depending on where the ticket is purchased, you get anywhere from three months to a year to claim your prize.

Generally speaking, the first call should be to an attorney experienced in assisting lottery winners, experts say. Other professionals also should be brought in to help, including a tax advisor and a financial advisor.

The winner also should make a copy of their ticket and store the original in a safe place (i.e., a lockbox or a bank safe deposit box). Additionally, it’s worth sharing the news with as few people as possible, experts say.

Meanwhile, the Mega Millions jackpot is at $34 million for Friday night’s drawing. Last week, a ticket sold in New York matched all numbers drawn to win about $431 million.

Your chance of hitting either game’s jackpot with a single ticket is miniscule. For Mega Millions, it’s 1 in 302 million and for Powerball, 1 in 292 million.

CHICAGO (CBS) — A day after learning former Chicago police officer Jason Van Dyke was beaten in a federal prison in Connecticut, his wife demanded to know why he was transferred out of Illinois in the first place, and called on authorities to do a better job of protecting his safety as he serves a nearly 7-year sentence in the murder of Laquan McDonald.

“I cannot and will not stand by somebody hurting my husband,” Tiffany Van Dyke said Thursday morning, flanked by her husband’s attorneys. “We are done being hurt. I’m standing up for my husband right now because he can’t. He cannot stand up for himself and fight anymore.”

“At the end of the day, I want my husband home. I need him to be safe,” she added. “The next time this could happen, they could kill him. I cannot bury my husband.”

Tiffany Van Dyke said she got a call Wednesday that her husband had been attacked at Danbury federal prison in Connecticut. Until then, she said she didn’t even know where her husband was serving his sentence, much less that he’d been transferred out of the Illinois prison system.

“I’m demanding reasons. I’m demanding answers as to why they took my husband from a state facility and put him in a federal facility,” she said. “If they assume and they claim that it’s for his safety, his safety has not been met. They have endangered him greatly.”

In a statement Thursday morning, Illinois Department of Corrections spokeswoman Lindsey Hess said Jason Van Dyke was transferred out of state custody “under the terms of the Federal Intergovernmental Agreement.

“For safety and security purposes, the Department does not discuss details of those transferred under this agreement. No further information is available at this time,” she added.

The Federal Bureau of Prisons confirms that Van Dyke was beaten, saying “minor injuries occurred.” Van Dyke’s legal team said the former officer informed them of the attack on Tuesday, a week after he was transferred to Danbury Federal Correctional Institution, a low- to minimum-security facility. Van Dyke’s attorneys said they were not informed about the transfer until after it happened.

Tiffany Van Dyke said she and her children have not spoken to her husband since he was sentenced on Jan. 18, and she hasn’t been able to find out how he’s doing after the attack.

“I do not know if he is safe at this moment. I do not know the extent of his injuries,” she said.

Attorney Tammy Wendt said Jason Van Dyke informed her of the attack Tuesday, during a conference call with his appellate attorneys.

She said she repeatedly has tried to call federal authorities to get answers about what happened but has been met with dead ends. She said Illinois prison officials also would not give her an explanation for the transfer.

However, Wendt said a prison employee reached out to her to tell her about the attack.

“He said he needed to let us know that Jason’s safety was at risk,” Wendt said.

While she did not know the extent of Van Dyke’s injuries, she said he suffered facial and head injuries in the attack.

Wendt said the confidential informant told her Van Dyke was placed in the general population at Danbury immediately after his transfer from Illinois, “as if he was led like a lamb to the slaughter.”

“Even though they call this a minimum security prison, these are violent people on the last leg of their sentence. That’s why they’re calling it minimum security,” she said. “To put a police officer who has spent his entire career locking up bad guys in with these bad guys, it doesn’t take a genius to know that that’s obviously going to get him in trouble, and it’s just unconscionable that this happened to him.”

RELATED: Jury Convicts Jason Van Dyke Of Second-Degree Murder, 16 Counts Of Aggravated Battery In Death Of Laquan McDonald

Wendt and lead defense attorney Daniel Herbert said they are doing everything they can to reach out to state and federal authorities to make sure something like this doesn’t happen again.

“I think it’s time that we have to look at this and say enough is enough,” Herbert said.

“We just hope that our leaders will come to their senses and recognize that Jason Van Dyke has all the rights of anyone that’s in prison,” he added. “He’s a tough man, and he’ll go in there and serve his sentence, and keep his mouth shut, but he needs to be protected.”

Tiffany Van Dyke said, before her husband was transferred to Danbury, he was in isolation while in prison in Illinois, on lockdown 23 hours a day.

“Any other normal prisoner in any other institution is allowed a telephone call, is allowed to see their loved ones, visit, is allowed to speak to family and friends, social workers, therapists, guidance from preachers, priests. Any of the above they’re allowed. My husband’s not being afforded those rights,” she said.

She also said it was “mind-boggling” to her that her husband would be transferred to a prison on the East Coast, saying it would be a major financial hardship for her and her daughters to visit him in Connecticut.

While Van Dyke was sentenced to 81 months — or nearly 7 years — in prison, he likely will serve about three, given credit for good behavior.

However, Illinois Attorney General Kwame Raoul and Special Prosecutor Joseph McMahon have filed a petition with the Illinois Supreme Court, seeking a new sentencing hearing in the case.

They argue it was improper for Judge Vincent Gaughan to sentence Van Dyke only for his conviction for second-degree murder and not for the 16 counts of aggravated battery, which they noted carry a longer minimum sentence.

Tiffany Van Dyke said the petition for a new sentencing for her husband “absolutely frustrates and sickens” her.

“Now the attorney general and the special prosecutor want to go for more time because they’re unhappy, because they think the judge didn’t do his job. I know for a fact the judge did his job. He did what he’s supposed to do. He followed the rule of law, and it sickens me the fact that they want to put more time on my husband,” she said.

More than 76,000 people tried to cross the U.S.-Mexico border in February — a “remarkable” leap that more than doubles the number of border apprehensions during the same period of time last year, and is also the highest number of any February in the past 12 years, according to officials.

The system is “well beyond capacity, and remains at the breaking point,” U.S. Customs and Border Protection Commissioner Kevin McAleenan told reporters on Tuesday as the agency released the “record numbers” of those trying to enter the U.S. through the southern border.

67 ILLEGAL IMMIGRANTS FOUND IN DEPLORABLE CONDITIONS INSIDE TINY NEW MEXICO ‘SHED’: ICE

Officials said that 76,103 people — an increase of 31 percent over January — were apprehended. Of those, 7,249 were unaccompanied children, and 40,385 were family units — totaling 60 percent of apprehensions.

Brian Hastings, the chief of law enforcement operations at the agency, told reporters that historically, 70 to 90 percent of apprehensions at the border included Mexican nationals.

As of Tuesday, he said, 70 percent of those arrested for attempting entry without proper documentation are from the “Northern Triangle of Central America,” which includes Guatemala, El Salvador and Honduras.

“It should be very clear from these numbers that we are facing alarming trends in the rising volumes of people illegally crossing our southwest border, or arriving at our ports of entry without documents,” McAleenan said.

NEARLY 200 ILLEGAL IMMIGRANTS APPREHENDED CROSSING BORDER IN NEW MEXICO

While fewer people overall are being apprehended crossing the border illegally each year, he said the increased numbers are “currently at our highest levels in over a decade both a border security and humanitarian crisis.”

The commissioner added that border patrol is also noticing a “stark increase” of those seeking asylum. Since October, there’s been a 90 percent increase over the “record levels” of asylum seekers since the last fiscal year, according to the agency, which added that 60 percent of those trying to enter the U.S. without proper documentation are “making claims of fear of return to their home country.”

Officials on Tuesday announced plans for a new processing center in El Paso, Texas, to manage the record number of people crossing the border. While not a permanent solution, it will be better suited to manage families and children, and handle medical care concerns.

“While our enhanced medical efforts will assist in managing the increased flows, the fact is that these solutions are temporary and this solution is not sustainable,” he said.

After two illegal immigrant children died while in Border Patrol custody, the agency stepped up medical screenings and announced sweeping changes that include more rigorous interviews as they enter into the system.

The data released on Tuesday comes as the GOP-controlled Senate plans to reject in a vote next week President Trump’s national emergency declaration at the border that would send extra funding there.
